Wills, Estates and Powers of Attorney

It is important that you have an up to date Will to ensure that your wishes upon your death bed are carried out. Many people do not update their Will and as such some of their belongings that they own at the time of their death are not expressly mentioned. If this occurs the executor will distribute those belongings as he/she thinks fit and in accordance with the Will in general. The executor's decision in this regard may not accurately reflect the distribution of your property as you intended.

Further, there are events that arise in your life that may act to invalidate your Will, for example, marriage and divorce. If your Will is over 3 years old we suggest you contact Creswick Saal Lawyers to discuss whether a new Will should be prepared to more accurately reflect your current situation.

Powers of Attorney allow a nominated person to perform various functions on your behalf. Such functions could include dealing with your finances or making decisions on your behalf in your absence. Powers of Attorney can be for a single event, for example, signing a document whilst you are on holidays or alternatively for an indefinite period.
